The first phase of the Energy Savings Opportunity Scheme (ESOS) is now in full effect whereby organisations were initially told that they must notify the Environment Agency (EA) of their compliance by the 5th December 2015.
On the 9th October 2015 the Environment Agency released an ‘Enforcement and Sanctions’ guidance document which states that whilst the deadline remains at 5th December 2015, organisations who do not meet the deadline will not be penalised provided they notify the Environment Agency of compliance before 29th January 2016. In addition, there will be no enforcement action against organisations who are seeking compliance through ISO50001 until 30th June 2016.
Enforcement action after these dates will be based on a written warning from the EA requesting further information as to the reason for non-compliance and subsequently would progress toward financial penalties for organisations who do not respond or organisations who are not taking steps to comply.
